   • To anticipate and resolve problems and conflicts with our products and services.
   • For verification and authentication purposes regarding requests or changes of any personal information or data.
   • For other purposes communicated to you at the time you provide or authorize the use of your information.
   • To enforce our Terms & Conditions and Privacy Policy or other legal agreements.
   • To outsource any of the tasks referenced in this Terms & Conditions and Privacy Policy, such as customer service.
   • In response to a subpoena, court order, or other legal process.
   • To establish or exercise our legal rights or defend against legal claims.
   • To share with a company controlled by, or under common control with NYS DMV for any purpose permitted by our Terms & Conditions and Privacy Policy.
   • When NYS DMV believes such use or disclosure is (a) necessary to investigate, prevent, or act regarding suspected illegal activities, fraud, or situations involving potential threats to the physical safety of any person, or (b) required by law.
   • To share with another government entity to carry out its functions unless (a) such records or information are being used for civil immigration purposes or (b) disclosure of such records or information are provided to any agency that primarily enforces immigration law, such as U.S. immigration and customs enforcement and U.S. customs and border protections, or to any employee or agent of any such agency unless such disclosure is pursuant to a cooperative arrangement between city, state and federal agencies which does not enforce immigration law and which disclosure is limited to the specific records or information being sought pursuant to such agreement.
   • In the event of a merger, acquisition, consolidation, divestiture, or bankruptcy of the NYS DMV.

5. Warranty

   The New York State DMV is not liable for any delays in the receipt of any SMS messages connected with this program. Delivery of SMS messages is subject to effective transmission from your wireless service provider/network operator. Carriers are not liable for delayed or undelivered messages.
